1. Trustee / Fiduciary:  受托人/受信人：

1. for breach of trust/fiduciary duty: remedies could be:-
   因违反信托/受信义务：补救措施可能包括：-

1. personal claim for account / disgorgement of profit [if received any profit]
   要求说明账目/追缴利润的个人索赔[如果收到任何利润]
2. personal claim for equitable compensation for:-
   要求公平赔偿的个人索赔，赔偿范围包括：-

• value of lost trust property [jointly and severally liable with Third Party];
  失去的信托财产的价值[与第三方共同及各自承担责任]；
• value of loss caused resulting from lost trust property [jointly and severally liable with Third Party].
  因失去信托财产而造成的损失的价值[与第三方共同及各自承担责任]。

3. proprietary claim of constructive trust for:-
   针对以下事项的推定信托的所有权主张：

1. misapplied trust property (or traceable substitutes), if still in its hands;
   被挪用的信托财产（或可追踪的替代物），如果仍在受托人手中；
2. profits obtained from breach.
   因违约获得的利润。

2. for breach of duty of care, skill & diligence: remedy is equitable compensation / damages (depending on the source of the duty), same as (a)(ii)
   违反谨慎、技巧和勤勉义务：补救措施是衡平赔偿/损害赔偿（取决于义务的来源），与(a)(ii)相同

2. Third parties (strangers):
   第三方（局外人）：

1. Knowing/Unconscionable receipt against recipients of trust property, with knowledge/notice of Trustee’s breach of trust
   针对信托财产的接收人，明知/非良心接受，且知悉/注意到受托人违反信托义务

1. personal claim for equitable compensation, same as (1)(a)(ii) [regardless whether trust property retained or not - controversial]
   衡平法补偿的个人索赔，与(1)(a)(ii)相同[无论是否保留信托财产 - 存在争议]

2. Dishonest assistance against persons who assisted, with dishonest intention
   针对以不诚实意图提供协助的人员，提出不诚实协助索赔

1. personal claim for equitable compensation, same as (1)(a)(ii);
   衡平法补偿的个人索赔，与(1)(a)(ii)相同；
2. personal claim for account / disgorgement of profits.
   利润计算/交出利润的个人索赔。

3. Asserting property rights? – proprietary claim of constructive trust for:-
   主张财产权？- 针对以下情况的推定信托的财产权主张：-

1. misapplied trust property (or traceable substitutes), if still in its hands (only applicable to recipients);
   被不当挪用的信托财产（或可追溯的替代物），如果仍在接收人手中（仅适用于接收人）；
2. profits obtained from breach.
   因违约而获得的利润。

4. Unjust enrichment for ignorance / want of authority [controversial]
   因不知情/缺乏授权而获得的不当得利[有争议]

1. personal claim for restitution of enrichment received.
   要求返还所获不正当得利的个人索赔。
