    • Some of you may wonder - why “law” for “non-law” students? The query seems reasonable.

There are reasons, however, for considering the teaching of law as a valuable element in the formation of future business people and professionals in general.  From your perspective, the most obvious reason is a practical one: Decisions and actions of professionals ignoring legal consequences may be risky and often unfortunate.

Thus, we aim that by the end of this course, you will have acquired enough knowledge to become a citizen who has awareness of her/his/their rights and obligations as well as the liabilities at stake and remedies available in five broad areas which shape the commercial world, namely: law of contracts, law of negligence, consumer protection, data protection, partnerships and corporations. These are the core contents of the Unit, which to a large extent refer to what businesses and professionals can legally do. A good understanding of this “can do” part is, it goes without saying, essential to success in this course.

The course aims to go beyond the mere learning of the “can do” in commerce, however. As legality and justice do not necessarily go hand in hand all the time, the “can do” test is not always enough to lead towards fair practices. Thereby, the “should do” reflection, which has become conspicuous by its absence in recent times, will be part of the discussion in lectures and tutorials as well. This is a second reason why the study of law is relevant to non-law students.

Looking forward to meeting you in person and on behalf of the Unit team, welcome to the study of commercial law. In the meantime, look at the information found below, and familiarise yourself with the unit structure and assessment regime. Also, look at the week one tab for the topic’s readings and do the pre-class work.

We wish you all the best for this semester. Our aim is for you to find the course rewarding, but bear in mind the more or less you learn does not depend so much on us, it depends largely on your own dedication and effort.

As the law affects all kinds of business activities, learning about the law as a non-lawyer is vital for everyone working in business. There are serious legal consequences for failing to comply with the law which in turn can impact upon business profitability and value. Understanding the law will enable you to appreciate how businesses are set up, to understand business risks, and to seize upon business opportunities, while also recognising when professional legal advice might be required. This unit covers essential topics in the Australian business world, including the Australian legal system, the law of contract, consumer protection, and the law of torts (including negligence as it affects business and as it applies to professionals). Privacy and data protection laws and the law of business organisations, including the law of agency, partnerships, and an introduction to company law, will also be covered.

    • The unit takes a student-centred approach. The unit is certainly challenging, as we aim to develop your capacity for critical thinking and analytical skills.

This unit will be taught via 90 minutes of online lectures, based upon readings.  Each week, your lectures and tutorials are taught concurrently: this means that your lectures and tutorials cover the same topic each week.  In this manner, when preparing for both lectures and tutorials, week by week, you will need to focus on the same topic and read the same sections of the textbook.

Tutorials are, by definition, the main opportunity for interactive learning. Tutorials are all about discussion. Thus, we encourage you to actively participate by asking or answering questions, as well as intervening with comments during the tutorial.

The main objective of tutorials is to discuss and analyse how the theory reviewed in the lecture may apply in concrete case scenarios. This is a key skill you need to learn and practice in order to succeed in this unit.

Tutorials are also the main chance to seek feedback and clarification about the content of the unit.

Finally, tutorials are a great occasion not only to learn from your classmates, but also to get to know them.

For tutorials, you should prepare as follows:

      • Read the textbook and listen to the lecture
      • Attempt the case scenario question assigned for each weekly topic. Do it on your own or in a group, but the important thing is just do it.
      • On the basis of this preparation, come to the class ready and willing to participate and discuss the main content.

Here, you can answer (complete or polish - remembering you should have already made an attempt) your tutorial question and prepare notes that will help you prepare for your assessments, and also complete optional activities designed to help you refine the knowledge and skills you have developed each week.
